Welcome to the website of North Shore Lactation, LLC (“NSL,” “Company,” “we,” “us,” or “our”), located at www.northshorelactation.com (the “Website”). NSL's team of International Board Certified Lactation Consultants (IBCLCs) provides in-person, in-home, and virtual lactation consultations to families throughout the greater Chicago area and Northern Illinois. By accessing or using the Website, you agree to comply with and be bound by these Terms and Conditions (“Terms”) and all applicable laws and regulations. If you do not agree to these Terms, please do not use the Website.

1. General Information; Website Does Not Provide Medical Advice

The Website is intended for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the direct advice of a qualified healthcare provider with any questions you may have regarding a medical condition, including infant feeding, breastfeeding, or lactation concerns. The Website itself does not offer lactation or any other medical advice. The content, information, and materials provided on the Website: cannot, and are not intended to, replace the relationship you have with your healthcare provider; are for general information purposes only; and shall not be construed, directly or indirectly, as providing lactation or any medical advice. You should always schedule an appointment and communicate directly with your IBCLC or provider for individualized medical advice, diagnosis, and/or treatment.

2. Medical Emergencies

If you are experiencing a medical emergency, please seek immediate medical attention by calling 911 or going to the nearest emergency room. This Website does not provide, and is not monitored for, emergency medical services, and messages sent through the Website, text, or online forms may not be reviewed immediately.

3. Eligibility and Website Use

You agree to use this Website only for lawful purposes and in a manner that does not: violate any applicable local, state, national, or international law or regulation; infringe upon or violate the intellectual property or other rights of others; damage, disable, overburden, or impair the Website's functionality; attempt to gain unauthorized access to the Website or any connected systems or networks; use automated systems, software, or processes to access the Website without our express written permission; or engage in fraudulent, deceptive, or misleading activity. 4. Appointment Scheduling, Cancellations, and Payment

If you request or schedule an appointment through the Website — whether an in-person, in-home, or virtual consultation — you agree to provide accurate and complete information. Appointments are subject to availability and confirmation. Payment, copayment, or deposit for services may be required in advance of or at the time of your appointment, as specified at booking. All fees for services are subject to change; any such changes will be communicated to you in advance of your appointment where reasonably practicable. Cancellations and rescheduling are subject to our separately posted Cancellation Policy, which is incorporated into these Terms by reference. If you no-show or cancel outside the applicable window, you may be charged a cancellation or no-show fee as described in that policy.

5. Insurance and Billing

NSL may bill your health insurance carrier as a courtesy, and estimates of coverage provided through any “Check My Coverage” tool, benefits-verification widget, or similar feature on the Website are estimates only, based on information available at the time of the request, and are not a guarantee of coverage, payment, or the amount you will owe. Coverage, eligibility, deductibles, copayments, and reimbursement are determined solely by your insurance plan. You remain responsible for any portion of the cost of services not covered or paid by your insurer, and you should confirm coverage details directly with your insurance carrier before your appointment.

6. Reviews, Testimonials, and Ratings

The Website may display patient reviews, testimonials, or aggregate ratings (for example, star ratings and review counts sourced from third-party platforms such as Google). These reflect the individual experiences and opinions of the reviewers, are not verified or independently audited by the Company for accuracy on an ongoing basis, and are not a guarantee that you will have the same experience or achieve the same results. Testimonials are used with the reviewer's consent where required and may be edited for length or clarity without altering their substantive meaning.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS AFFILIATES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ANY CONTENT ON IT. NOTHING IN THIS SECTION IS INTENDED TO LIMIT ANY CLAIM ARISING FROM PROFESSIONAL MEDICAL NEGLIGENCE, WHICH IS GOVERNED BY APPLICABLE ILLINOIS LAW AND ANY SEPARATE CONSENT-FOR-CARE DOCUMENTATION YOU SIGN IN CONNECTION WITH CLINICAL SERVICES.

15. Indemnification

The Company reserves the right, in its sole discretion, to suspend or terminate your access to the Website at any time, without notice, for any reason, including violation of these Terms.

17. Governing Law

These Terms, and your use of the Website, are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict-of-law principles. Subject to Section 19 (Binding Mutual Arbitration), you agree to submit to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois, for any dispute not subject to arbitration.

18. Consent for Care and Telehealth

If you receive in-person, in-home, or telehealth services from NSL, your care is additionally governed by a separate Consent for Care and, where applicable, Consent for Telehealth Treatment, which you will be asked to review and sign before your first visit. In the event of a conflict between these Terms and a signed consent or care agreement specific to your treatment, the signed consent or care agreement controls with respect to your clinical care.

19. Binding Mutual Arbitration; Class Action Waiver

Except for claims involving intellectual property or professional medical negligence (which are excluded from this arbitration provision and may be brought in a court of competent jurisdiction), any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website, including the determination of the scope or applicability of this agreement to arbitrate, will be resolved by binding arbitration in Cook County, Illinois, before a single arbitrator, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

20. Severability

If any part of these Terms is found to be unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity or enforceability of the remaining provisions.

21. Entire Agreement

These Terms, together with our Privacy Policy, Cancellation Policy, and any signed Consent for Care or Consent for Telehealth Treatment applicable to your clinical services, constitute the entire agreement between you and the Company regarding your use of the Website, and supersede any prior agreements regarding the same subject matter.

22. Updates to These Terms

The Company reserves the right to modify or replace these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. By continuing to use the Website after any modifications, you agree to be bound by the revised Terms.
